Your Lease
The following are very brief summaries created for our purposes and refer only to clauses that may be relevant to day-to-day estate management. This is not intended to be a legal interpretation but purely a guide towards the actual text (Clause numbers are given in brackets). We suggest that anyone interested should obtain a copy of the Lease and refer to it for full details or obtain further advice from your solicitor.

Lease

The Lessee having entered into a Lease (or as an assignee of the Lease) has made a Deed of Covenant to abide by the terms of the Lease, in which the Lessee and the Landlord (the Lessor) are legally bound by that contract and the covenants therein.

The term of the lease is 99 years from 1981.

The Lessee makes two fixed payments each year plus the balance proportion of the costs of maintenance and repair (7th Schedule)

21 days are allowed for payments.

Parts of the Building and Land reserved for the Landlord (not demised to the Lessee)
(1st Schedule)

  1. Halls, Stairs, Landings and other common parts of the building
  2. All external parts but not the frames and glass of the windows
  3. Any conduit, pipe or service not used solely by one flat.

The Parts demised to the Lessee (inter alia)
(2nd Schedule)

  1. Internal plaster & finishes (not the structure), .
  2. Doors and frames,
  3. Window frames and glass
  4. Ceiling and floor surfaces, finishes and coverings.
  5. All conduits for services exclusive to the demise.
  6. Internal Fixtures and fittings.
  7. A car space.
  8. A cupboard in the drying area.
The Lessees Rights and Obligations and the Regulations (inter alia)

Rights in Schedule 3

  1. To pass through the reserved passages, stairs and entrance
  2. To place a rubbish bin in the designated area
  3. To use the drying area for drying household washing

    Obligations in Schedule 6

  4. Repair and maintain the demised premises (Cl 4)
  5. Occupation by a single family only for residential purposes (Cl 6)
  6. Not to place a sign or notice on the outside (Cl 7)
  7. Not to cause annoyance, nuisance, damage or disturbance (Cl 9)
  8. No alterations without prior consent (Cl 10 a&b)
  9. Allow the Landlord to enter to inspect or carry out works upon 48 hours notice. (Cl 13)
  10. Lessee to pay expenditure (or a proportion of) by the Landlord (Cl 15)
  11. A new owner must enter into a direct covenant with the Landlord (Cl 20)
  12. Must give notice to the Landlord of every assignment or subletting (Cl 22)

    Regulations in Schedule 8

  13. Not to damage the common parts (reserved parts) (Cl 1)
  14. Not to hang washing anywhere than the Drying Area (Cl 2)
  15. No animals that may cause a nuisance (Cl 3)
  16. Not to cause a noise audible outside the premises between 11pm and 8am (Cl 4)
  17. Not to cause a drain blockage (Cl 5)
  18. No children to loiter or play in the common parts (reserved parts) (Cl 8)
  19. Lay carpet or underfelt on the floors (Cl 10)
  20. Not to attach an aerial to the outside (Cl 11)
  21. Parking space not to be used for works or any other purpose (Cl 12)

Landlords Rights and Obligations

  1. Right of access to demised premises to carry out the obligations upon 48 hours notice (Sch 4)
  2. Maintain, repair and paint the reserved parts (not the car spaces). (Sch 7)
  3. Ensure compliance with fire and other regulations (Sch 7)
  4. Insure the Building (Sch 7)
