YOUR LEASE

Lesses Obligations to the Landlord

Lessees Rights

 

The following are very brief summaries and refer only to clauses that may be relevant to day-to-day occupation. This is not intended to be a legal interpretation but purely a guide towards the actual text (clause numbers are given in brackets). We suggest that you obtain a copy of the Lease and refer to it for full details or obtain further advice from your solicitor.

You (the Lessee) have entered into a Lease in which you, the Management Company and the Landlord (the Lessor) are all parties who are legally bound by that contract and the covenants therein

Lessees Obligations to the Landlord

  1. You must pay your ground rent in equal half yearly installments on 24th June & 25th December every year. (Note:
  2. The Landlord is not obliged to remind you.) (Clause 3.4)
  3. You must not give up or let out part of the property
  4. You must keep the property in good repair and not alter any of the walls, ceilings, floors or partitions. (Clauses 5.1 & 5.2)
  5. You must not make any structural alterations or additions whatsoever without the Landlords consent. (Clause 5.3)
  6. You must paint the interior of the flat at least every 7 years (Clause 5.4)

Lessees Obligations to the Landlord the Company and other Lessees

  1. You must pay your service charges to the Company (Clause 5.7 and subsections)
  2. You must comply with any reasonable regulation that the Company or Landlord may make for the good management of the estate. (Clause 5.8)
  3. If you sell your flat you must give notice to the Company at least 7 days before completion and ensure that the purchaser fulfills all requirements to become the new member. (Clauses 5.9 & 5.9.1)
  4. The flat may only be used as a private residence for one family. (Schedule 3(1))
  5. Not to do anything that might be a nuisance/annoyance to any neighbour. (Schedule 3 (2))
  6. Not to do anything that might cause the insurance to be void. (Schedule 3 (3))
  7. Music must not be played between 12 midnight and 8am, nor any other noise which might cause a nuisance or annoyance to any adjoining property (Schedule 3 (5))
  8. No notice may be placed so that it can be seen outside. (Schedule 3 (6))
  9. No clothes may be hung outside, no window boxes or flower pots or other like objects outside the property. (Schedule 3 (7))
  10. No pet may be kept that may cause a nuisance damage or annoyance. (Schedule 3 (8))
  11. No aerial or dish may be fixed to the block. (Schedule 3(9))
  12. Not to leave refuse anywhere other than in the bins provided. (Schedule 3 (11))
  13. You must clean the inside of your windows at least once a month. (Schedule 3 (14))
  14. No 'For-Sale' boards may be erected. (Schedule 3 (15))
  15. No commercial or industrial vehicle may be parked in any parking space. (Sch 3 (16))
  16. The Car parking spaces are not to be used for washing motor vehicles. (Sch 3 (17))
  17. Parking (usually defined as a domestic private motor vehicle of roadworthy condition and in regular use) is only allowed in the designated parking areas. (Schedule 3 (19 & 20)



The Management Scheme


1. The Developers (Weston Homes plc) created a Management Company named Billet Road Management Company Limited.
2. Upon entering into the Covenants and all other requirements of the Management Company the first named tenant becomes a member of the Company
3. Provided that the Lessee pays his service charges the Management Company will (inter-alia) under Schedule 4:

v Maintain the structure, walls and boundaries. (1a)
v Maintain the common services and facilities. (1b)
v Maintain the common passages landings and staircases. (1c)
v Maintain the dustbin areas paths and parking spaces. (1d)
v Maintain all trees, shrubs, plants and landscaping forming part of the Gardens (1e)
v Pay any communal water consumption. (2.)
v The Company may at its option maintain arrangements for refuse containers and their collection, keep the internal common parts clean and lighted and maintain the gardens.((3) (3a) (3b))
v Maintain the master television aerial (4)
v The Company can at its own discretion provide any service. (5)
v Decorate the external parts of the Property. (6).
v Maintain insurance on the Building. (7)
v The Company shall take action to ensure that Tenants accord with the terms of the Lease (8)

Lessees Rights


Subject to the payment of all costs charges and expenses, Schedule 1 of the Lease provides inter-alia for the following:
1. Access and to pass through the common halls and stairways and to pass over the paths, steps and driveways (1 &10)
2. To use the gardens but not to play games or cultivate edible plants. (2)
3. To deposit household refuse in the bins provided. (8)
4. To connect to the master TV aerial. (9)
